Plaintif menyatakan, perkataan-perkataan fitnah (Tian Chua) itu membawa maksud, UMNO merancang insiden pencerobohan di Lahad Datu, UMNO pembelot negara yang kononnya membawa masuk pejuang Kesultanan Sulu di Lahad Datu dan UMNO sengaja mahu menakut-nakutkan rakyat dengan insiden tersebut.

Akibat penyiaran kata-kata fitnah itu, plaintif mendakwa, reputasi UMNO terjejas kerana kes pencerobohan di Lahad Datu melibatkan kedaulatan negara yang juga merupakan isu sensitif dan mengakibatkan pertumpahan darah serta tuntutan yang tidak wajar oleh pihak luar terhadap negeri Sabah yang diisytiharkan milik Malaysia sejak sekian lama.

BADUT UMNO mengakui DAKWAAN Tian Chua amat berat. Tapi tanpa permohonan maaf pun, mereka setuju saman tersebut ditarik balik. Macam tak masuk akal atau macam kerja orang yang tidak menggunakan akal pun ada jugak...

NIK NAZMI DI MAHKAMAH 4 JUN 2013

Pengarah Komunikasi Parti Keadilan Rakyat (PKR), Nik Nazmi Nik Ahmad, dihadapkan ke Mahkamah Sesyen di sini, hari ini atas dakwaan menganjurkan perhimpunaan tanpa kebenaran, 8 Mei lalu. 

Nik Nazmi, 31, mengaku tidak bersalah dan minta dibicarakan selepas pertuduhan mengikut Akta Perhimpunan Aman 2012 dibacakan terhadapnya di depan Hakim Rozina Ayob, sebentar tadi.

Peguam Eric Paulsen yang mewakili Nik Azmi memberitahu mahkamah, pihaknya akan memfailkan secepat mungkin permohonan bagi membatalkan pendakwaan ke atas anak guamnya berdasarkan alasan salah guna kuasa kerana pendakwaan itu, lebih bersifat politik. 

Mahkamah menetapkan 4 Jun ini untuk sebutan kes. 

RAFIZI RAMLI DI MAHKAMAH 10 JUN 2013

Kes Pengarah Strategi Parti Keadilan Rakyat, (PKR) Mohd. Rafizi Ramli dan seorang bekas kerani bank yang menghadapi pertuduhan di bawah Akta Bank dan Institusi-Institusi Kewangan (Bafia) akan disebut semula di Mahkamah Sesyen di sini pada 10 Jun ini.

Hakim G. Rames menetapkan tarikh tersebut sementara menunggu rayuan yang dikemukakan oleh Mohd. Rafizi terhadap keputusan Mahkamah Tinggi di sini yang menolak permohonan untuk membatalkan pertuduhan yang dihadapinya, diputuskan oleh Mahkamah Rayuan. Rayuan tersebut akan didengar pada 23 Mei ini.

Mohd. Rafizi, 36, dan Johari Mohamad, 42, yang hadir di mahkamah hari ini diwakili peguam bela, Michelle Yesudas sementara pendakwaan dikendalikan oleh Timbalan Pendakwa Raya, Mohd. Haziq Razali.

Pada 23 November 2012, Hakim Mahkamah Tinggi, Datuk Ghazali Cha menolak permohonan Mohd. Rafizi untuk mengetepikan pertuduhan itu selepas mendapati permohonan itu bersifat pramatang.

Mohd. Rafizi memfailkan permohonan itu pada 10 September tahun lalu atas alasan prosiding jenayah di Mahkamah Sesyen berkenaan bermotifkan politik.

Pada 1 Ogos 2012, Mohd. Rafizi mengaku tidak bersalah atas tuduhan mendedahkan maklumat akaun bank tiga syarikat yang terlibat dalam projek Pusat Fidlot Nasional (NFC) kepada konsultan media, Yusof Abdul Alin dan wartawan akhbar The Star, Erle Martin Carvalho.

Dia didakwa mempunyai akses kepada salinan rumusan akaun Public Bank milik National Feedlot Corporation Sdn. Bhd. (NFCorp), National Meal & Livestock Sdn. Bhd., Agroscience Industries Sdn. Bhd. dan akaun peribadi Pengerusi Eksekutif NFCorp, Datuk Seri Dr. Mohamad Salleh Ismail.

Mohd. Rafizi didakwa mengikut Seksyen 97(1) Akta Bafia yang boleh dihukum mengikut Seksyen 103(1)(a) akta sama yang membawa hukuman penjara maksimum tiga tahun atau denda maksimum RM3 juta atau kedua-duanya.

Johari yang merupakan bekas kerani (bahagian kredit) Public Bank Bhd. cawangan Jinjang pula didakwa bersubahat dengan Mohd. Rafizi melakukan perbuatan itu pada masa, tarikh dan tempat yang sama.

Lelaki itu didakwa mengikut Seksyen 112(1)(c) akta tersebut dibaca bersama Seksyen 97(1) akta sama yang memperuntukkan hukuman serupa.

TIAN CHUA DI MAHKAMAH DIJANGKA JUN 2013

UMNO berhak di sisi undang-undang atau mempunyai locus standi untuk menyaman Naib Presiden Parti Keadilan Rakyat (PKR), Tian Chua dan dua lagi berhubung artikel diterbitkan dalam portal KeadilanDaily.com. yang didakwa mengaitkan UMNO dengan kejadian pencerobohan di Lahad Datu, Sabah.

UMNO melalui Setiausaha Kerjanya, Datuk Ab. Rauf Yusoh pada 15 Mac lalu memfailkan saman terhadap Tian Chua atau nama sebenarnya, Chua Tian Chiang; Editor portal berkenaan, Fazallah Pit; dan penulis artikel, Aisha Geoffrey.

Menurut Ab. Rauf, hak untuk membawa kes itu ke Mahkamah Tinggi di sini adalah selaras dengan peruntukan Seksyen 9(c) Akta Pertubuhan 1966.

Seksyen itu memperuntukkan, sesuatu pertubuhan boleh mendakwa atau didakwa atas nama mana-mana seorang anggotanya seperti yang dinyatakan kepada Pendaftar Pertubuhan dan didaftar olehnya sebagai pegawai awam pertubuhan bagi maksud itu.

Perkara tersebut terkandung dalam afidavit Ab. Rauf bertarikh 7 Mei lalu yang dikemukakan bersama permohonannya untuk membatalkan pembelaan yang difailkan oleh ketiga-tiga mereka pada 23 April lalu.

Ab. Rauf berbuat demikian atas alasan pembelaan mereka tidak mendedahkan klausa pembelaan yang munasabah, mengaibkan, remeh dan menyusahkan.

Tian Chua dalam pernyataan pembelaan antaranya menyatakan, kenyataannya adalah komen yang wajar dan dibuat di bawah perlindungan bersyarat demi kepentingan awam berkenaan isu keselamatan negara dan ketelusan media.

Peguam Raihanah Ariffin yang mewakili Ab. Rauf selaku pihak plaintif memberitahu pemberita, permohonan anak guamnya itu akan didengar pada 12 Jun ini.

Tarikh itu ditetapkan oleh Hakim Rosilah Yop ketika pengurusan kes saman itu di kamar beliau hari ini dengan kehadiran peguam S.H. Tan mewakili Tian Chua, Fazallah dan Aisha yang dinamakan sebagai defendan pertama hingga ketiga.

Image: Malaysia has called in air support and armor to confront a bizarre terrorist invasion in its eastern state of Sabah.

The West’s woeful, irresponsible coverage of a burgeoning region-wide destabilization, fits in nicely with its coverage of US-Saudi funded/armed terrorism around the world, including in Syria where US-funded terrorists of the so-called “Free Syrian Army” have just taken dozens of UN peacekeepers hostage in the Golan Heights – just days after the US announced it would fund the terrorists further, to the tune of $60 million and the West’s Arab partners have just granted the terrorist faction Syria’s seat at the “Arab League.”

Terrorists are US-Saudi Funded Extremists – Part of Engineered Destabilization.

While the West pleads ignorance over the identity of the militants held up in the jungles of Malaysia’s Sabah state, the militant organizations themselves have declared thousands more in reinforcements are being arranged in the Philippines to join and exasperate the conflict. The Free Malaysia Today newspaper reported in its article, “10,000 Tausugs to sail to Sabah,” that :

Thousands of Tausug from Basilan, Sulu and Tawi-Tawi have sailed to Sabah to reinforce members of the so-called royal army of the sultanate of Sulu who are fighting it out with Malaysian security forces, a Moro National Liberation Front official said Tuesday.

The Moro National Liberation Front (MNLF) of course, is one of several of Al Qaeda’s franchises in Southeast Asia, and spun off the notorious terrorist organization, Abu Sayyaf, a US State Department-listed foreign terrorist organization with direct ties to Al Qaeda.

The Philippines’ terrorist organizations, located amongst the country’s southern islands have long held ties to Al Qaeda and receive funding and support from Saudi Arabia. AFP reported in their 2010 article, “WikiLeaks: US suspected Saudi ambassador to the Philippines of terror link,” that:

The United States suspected a Saudi Arabian ambassador to the Philippines of potential involvement in funding terrorists, according to US diplomatic cables released by WikiLeaks this week.

The report would also state:

Francis Townsend cited Waly’s intervention to secure the release of two members of an Islamic charity detained in the Philippines, the cable showed.

The group was suspected of funnelling funds to Al-Qaeda-linked groups based in the southern Philippines.

It continued stating:

The February 24, 2007, US embassy cable named the charity suspected of terror financing in the Philippines as IIRO, which stands for the International Islamic Relief Organisation.
Intelligence agencies have said IIRO was set up by Muhammad Jamal Khalifa, a brother-in-law of Al-Qaeda chief Osama bin Laden.

The report concluded by stating:

Overall, the WikiLeaks cables singled out Saudi Arabia as the key source of funding for radical Islamist groups including Al-Qaeda, the Taliban, Lashkar-e-Taiba and Hamas.

Saudi Arabia is of course is the chief financier of Al Qaeda, and is currently leading efforts to fund, arm, and fill the ranks of Al Qaeda’s franchises from Mali and Libya, to Syria and Iraq. A multitude of reports from across the West have identified Saudi Arabia as the lynch pin in Al Qaeda’s global terror campaign, including the US Army West Point Combating Terrorism Center.

Its reports “Al-Qa’ida’s Foreign Fighters in Iraq” and “Bombers, Bank Accounts and Bleedout: al-Qa’ida’s Road In and Out of Iraq,” identify a vast terrorist network maintained by the Saudis that recruits, arms, and funds terrorists from across the Muslim World, and can funnel a mercenary army into any desired nation. At the time, the desired nation was Iraq. In 2011, it was Libya. Today it is Syria. The same network that US soldiers fought in Iraq is verifiably in use today, in support of US regime-change operations in Syria.

And while it is acknowledged across even the Western mainstream media that Saudi Arabia is a notorious state-sponsor of terrorism, including the terrorists allegedly behind the September 11, 2001 attacks that left 3,000 Americans dead, the US has had a decades-long, deep economic and military relationship with the despotic Arabian autocracy.

The US maintains permanent military bases inside Saudi Arabia, funds the Saudi military, and has recentlyconcluded the largest arms deal in US history with the Saudis. Additionally, Saudi Arabia’s brutally repressive internal security apparatus is a creation of US advisers and operators.

The Saudi royal family and the elite amongst the US corporate-financier Fortune 500, have maintained deep financial and political ties as well. Saudi Arabian corporate-financier interests (run by the royal family) are tied directly to Wall Street and London via conglomerations like the US-Saudi Arabian Business Council and representation upon the JP Morgan International Council (Khalid Al-Falih of Saudi Aramco, amongst the highest valued companies on Earth).

This also includes the Bin Laden family, whose multi-billion dollar Saudi Binladin Group is an active member of the US-Saudi Arabian Business Council and plays a central role in deciding bilateral policy for the benefit of collective US-Saudi corporate-financier and corresponding geopolitical interests. At one point, the Bin Ladens and the Bush family sat around the same table, as both families were involved in the equity firm, Carlyle. In fact, Bush and Bin Laden family members were clicking champagne glasses together in Washington on 9/11, an event that would make both families immensely rich in the coming decade.

It is clear, most acutely in Libya and Syria, that the use of Saudi Arabia’s global Al Qaeda mercenary army serves both Saudi Arabia’s interests as well as Western geopolitical ambitions, including to exact regime change around the world. And it just so happens that the West and Saudi Arabia both seek regime change in currently Russo-Iranian-Chinese friendly Malaysia.

West Attempts to Install Client Regime in Malaysia

The West has been propping up Malaysian opposition candidate Anwar Ibrahim for years.

Anwar Ibrahim, head of Malaysia’s opposition coalition, which includes the Malaysian Islamic Party (PAS), has spent a lifetime in the service of Western interests. Anwar Ibrahim was Chairman of the Development Committee of the World Bank and International Monetary Fund (IMF) in 1998, held lecturing positions at the School of Advanced International Studies at Johns Hopkins University, was a consultant to the World Bank, and a panelist at the Neo-Con lined National Endowment for Democracy’s “Democracy Award” and a panelist at a NED donation ceremony - the very same US organization whose subsidiaries are funding and supporting Bersih, a faux-pro-democracy Western-funded street movement that in fact was created by, and in the service of Anwar Ibrahim’s political ambitions.

Bersih’s street activism fits into a global pattern of Western-backed “color revolutions,” where meddling in sovereign nation’s political processes to install Western-client regimes is disguised as “democracy promotion.”

Anwar Ibrahim’s affiliations with Malaysian “Islamists,” the already active political subversion his US State Department-funded Bersih movement is sowing in Malaysia’s streets, and his Western backers’ habitual support for terrorism internationally as a geopolitical tool, raises the possibility that his opposition movement is complicit in the conveniently timed militant destabilization Malaysia now faces, only months before 2013′s general elections.

This may be why the Western media refuses to properly cover an otherwise very noteworthy conflict. The fact that these militants are emanating from long-time US ally, the Philippines, and the Philippines’ current role in assisting the US “pivot” towards Asia, and more specifically facilitating a proxy confrontation with China, illustrates the greater regional implications at play. The US intends to install client regimes in Myanmar led by Aung San Suu Kyi, Thailand led by Thaksin Shinawatra’s despotic political dynasty, and in Malaysia led by Anwar Ibrahim. Together, this front will then be turned against Chinese interests as part of a long-planned desire to encircle and contain China.

It will be done so under ASEAN and at the cost of Asia’s stability and prosperity.

The future of Asia hangs in the balance, and therefore conflicts like Malaysia’s battle against armed extremists in Sabah may not be covered by the Western press, but it must be covered by the alternative press. The unhinged insanity that is now spilling blood on Malaysia’s shores, also represented by the West’s proxy Anwar Ibrahim and his attempts to provoke street protests against the ruling government, illustrates just how dangerous the current Anglo-American international order is, and how far its reach extends.

We must  identify the corporate-financier interests driving this agenda, – interests we most likely patronize on a daily basis, and both boycott and permanently replace them to erode the unwarranted influence they have used, and will continue to use against people the world over.

GENERAL SANTOS CITY, Philippines—President Aquino on Wednesday declared that he would not allow the sultanate of Sulu to drag the country into a conflict with Malaysia.

A day after Malaysian forces launched a major operation to flush out the sultan’s armed followers at Lahad Datu town in Sabah, Aquino noted that the family of Sultan Jamalul Kiram III was engaged in a “propaganda war” ostensibly to elicit sympathy from Filipinos.

Addressing a campaign rally of Team PNoy, the President turned emotional as he explained his decision not to discuss the Sabah claim with Kiram unless the sultan first recalled his followers from Sabah.

“I appeal to you—we should be really clear on this—this incident is wrong. If this is wrong, why should we lend support to this? We should support what is right … which will lead us to brighter prospects; the wrong option will only bring us ruin. That’s it, that’s my simple message,” he said to applause from the audience.

“Let’s not forget: What they are pushing for is their right as so-called heirs of the sultan of Sulu. It’s not yet clear if their rights have been transferred to the Philippines. But we will all be affected by their conflict (with Malaysia),” the President lamented.

Women spokespersons

A Palace official told the Inquirer that the President had been advised against further commenting on the Sabah standoff but still made these impromptu remarks during the rally to explain the government’s position in clear and unequivocal terms.

The official, who was not authorized to talk to reporters, admitted that the Palace’s position was becoming unpopular with the public, referring to Kiram using women as spokespersons.

In his speech, the President reiterated his call for the Kirams to stand down, order their followers to leave Lahad Datu, “and talk about your problem through a peaceful and orderly process.”

“Was that suggestion wrong?” he asked. “Is it right for others to seek support for those (at Lahad Datu) who are carrying arms that have led to killings?”

He admitted that the relations between Malaysia and the Philippines had been colored by the Sabah issue.

“Is it the interest of the Kirams, or the interest of the nation? Naturally, (we would prefer to achieve) both. This made me think, and we have truthfully studied this: They are claiming Sabah. Where did the problem that they no longer own it come from? Wasn’t this caused by their forebears who gave the lease or authority to the British to administer Sabah?” Aquino said.

“If they have a problem with the (lease) agreement, and if we are interested (to pursue this), we should talk about it through a peaceful dialogue,” he said. “If the agreement is flawed, let’s correct it.”

Conflict with China

Without mentioning China, the President noted that the country had a territorial dispute with a “big nation” but he said he never advocated the use of force to settle the issue.

“We brought the issue to the (international) court to press for our right as a state. Whichever community, wherever you are in the whole wide world, an armed group entering the (territory) is not the key to a peaceful and orderly dialogue?” he said.

In the last three weeks, Aquino admitted that he learned a lot from studying the Sabah conflict.

Jabidah massacre

He recalled that his father, the late Sen. Benigno Aquino Jr., had delivered a privilege speech on the Jabidah massacre in 1968 that later sparked the Moro revolt.

He cited the power of attorney mentioned by then Sen. Ambrosio Padilla dated Feb. 1, 1968, “allegedly executed by the heirs of the sultan of Sulu, in favor of President Ferdinand E. Marcos, recognizing the authority and power of the President to represent them in their settlement of their propriety rights over Sabah.”

“Therefore, I, as father of the nation, it is my obligation to safeguard the welfare of all Filipinos,” Aquino said, highlighting the decision of Malaysia to broker peace talks between his administration and the Moro rebels.

“Our relationship was becoming stronger when this (conflict) suddenly broke out … Someone in Malaysia will say: Is this how our relations with the Philippines will progress? We will always quarrel over Sabah? Are we fighting over this?”

Siapa Bekal Senjata Canggih Kepada Penceroboh Lahad Datu?

Untuk menjawab soalan di atas, mungkin kita perlu melihat kepada kenyataan Presiden Filipina, Benigno Aquino beberapa hari lepas bahawa wujud petanda dan bukti-bukti jelas pencerobohan di Lahad Datu adalah satu konspirasi.

Ini kerana jelas beliau, tidak mungkin Jamalul Kiram mempunyai kemampuan kewangan untuk melaksanakan operasi pada skala itu.

Aquino dilaporkan berkata, Jamalul Kiram perlu membelanjakan sekurang-kurangnya 100,000 Peso (RM7,611) sekiranya mahu menyewa satu bot besar bagi membawa pasukannya ke Lahad Datu

Beliau berkata, keluarga Kiram menggunakan dua bot besar dan sebuah bot laju untuk membawa pengikut mereka ke Sabah. Justeru dari mana mereka mendapat wang yang banyak untuk menyewa bot-bot berkenaan?

Aquino dengan nyata menzahirkan Jamalul Kiram tidak mampu membiayai operasi seperti itu.

Malah katanya, Jamalul Kiram yang menghadapi masalah buah pinggang, terpaksa menerima sokongan kewangan dari Philippine Charity Sweepstakes Office (PCSO) untuk melakukan rawatan dialisis dengan kerap.

“Dana untuk makanan, wang yang ditinggalkan, kumpulan yang disepadukan, kritikan yang senada, semuanya berarah kepada satu konspirasi,” katanya dalam satu sidang media di Manila.

Aquino menegaskan beliau bukan bercakap tanpa bukti dalam tuduhannya bahawa wujud konspirasi dalam isu pencerobohan di Sabah.

Kini, jom kita lihat kepada satu lagi aspek dalam kes di Lahad Datu iaitu jumlah senjata canggih dan mahal yang dimiliki oleh pengikut Kiram, yakni seorang tua yang perasan dirinya sultan tetapi perlu mendapatkan bantuan kerajaan Filipina untuk rawatan dialisis.

Kemampuan memiliki senjata untuk penembak tepat adalah antara yang paling memeranjatkan.

Ini kerana rifle penembak tepat yang paling murah pun dikatakan berharga RM60,000 satu unit.

Malah ada yang mencecah harga RM200,000 ke RM300,000 dan sehingga lebih RM1 juta (jarak tembakan melebihi 5 kilometer).

Harga senjata adalah berdasarkan jenis dan aksesori tambahan pada senjata berkenaan.

Malah, jika mengikut gambar dan maklumat sebelum ini, kumpulan Kiram juga dipercayai memiliki FN FNC Para Carbine. Mereka juga dipercayai memiliki senjata-senjata yang dihasilkan sendiri.

Secara keseluruhan, dianggarkan seramai 180 pengganas memasuki Lahad Datu 4 minggu yang lalu dan jumlah senjata mereka tidak dapat dipastikan dengan tepat.

Gambar utama di atas memperlihatkan kumpulan Kiram III yang diambil pada Oktober tahun lalu dan senjata yang dimiliki mereka.
